Indonesia has introduced new rules to make it easier for people to protect their intellectual property. The Commercial Court of the District Court of Central Jakarta has issued a Decree No. W10-U1/05/KP.00.3/I/2023, which says that people must now register online with the court to enforce their intellectual property rights. This new system, called e-court, will take effect on January 24, 2023, and covers disputes related to commercial matters and intellectual property.
With e-court, people can register their cases online, make payments electronically, receive electronic summons, and carry out legal proceedings through the internet. However, people can still go to court in person if they prefer.
This new decree is in response to Supreme Court Regulation (“PERMA”) Number 1 of 2019, which outlines how e-court systems should be used in court proceedings. Other commercial courts in Indonesia have not yet implemented this system, but it is hoped that this new decree will encourage other courts to follow suit.
In other regions of Indonesia, such as Surabaya, Semarang, Medan, and Makassar, the commercial courts have not yet implemented the e-court system. This new decree is expected to inspire other commercial courts to follow suit and implement the e-court system in their court proceedings, including disputes related to intellectual property.
